1. Acceptance of Terms
These Terms of Use constitute a legally binding agreement between you and QUIKFORGE LIMITED (trading as "Sitetals"), a company incorporated in Hong Kong (BR No. 79555262), with registered office at Unit 2A, 17/F, Glenealy Tower, No.1 Glenealy, Central, Hong Kong S.A.R. ("we", "us", "Sitetals").
By accessing or using Sitetals.com (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.
Territorial scope of the offer. The free scan is available worldwide. Paid Reports are offered only in the countries listed at checkout, and orders can be placed only from those countries. Sitetals makes no offer to sell, and does not sell, into any other jurisdiction. Availability of this website in a country is not an offer to sell in that country.
2. Description of Service
Sitetals.com provides independent compliance research for websites operating in France, Germany and Singapore. The Service reviews publicly accessible information from your website and generates reports indicating potential compliance issues under applicable regulations including GDPR, CNIL guidelines, TDDDG (formerly TTDSG), LCEN (as amended by the SREN Act), PDPA, and related EU and Singapore directives.
2.1 Eligibility — business customers
Paid plans are offered to businesses only. Sitetals makes no offer to sell a paid plan to a consumer, and an order for a paid plan may be placed only for the purposes of a trade, business, craft or profession. You must give the legal name of the business placing the order at checkout; by placing the order you state that the order is made for the purposes of that business. For orders billed to an EU member state a valid VAT identification number is also required, and we check it against the European Commission's VIES service before the order can be completed. Outside the European Union we do not check the business name you give against any register, and we rely on the statement you make when you place the order. We may refuse or cancel an order where the business details given are incomplete, inaccurate, or cannot be verified. The free compliance check is open to everyone and is not affected by this clause. This restriction is our current commercial policy and may change; the countries in which paid plans are offered at any time are those listed at checkout (see §1). This clause states who we sell to. It does not change §6.6, §6.7 or §6.9, and it does not remove any mandatory statutory right that applies to you if a court of competent jurisdiction nevertheless determines that you are a consumer (see §6.7, §11 and §12).
3. Not Legal Advice
The results provided by Sitetals.com are for informational purposes only and do not constitute legal advice. The Service cannot replace the professional judgment of a qualified legal practitioner. You should always consult a qualified lawyer before taking action based on any findings from our Service.
Sitetals.com is not a law firm and does not establish an attorney-client relationship.
4. Scope and Limitations of Scanning
Our technical review analyses publicly accessible aspects of your website. The review:
- Is based on information publicly available at the time of scanning
- Cannot access password-protected areas or dynamically loaded content not present in the initial page load
- Checks against known regulatory requirements but may not reflect the most recent regulatory guidance or enforcement interpretations
- Does not guarantee that a compliant result means your website is fully compliant with all applicable laws
As part of the scan, Sitetals may perform passive HTTP checks on your submitted domain — including requests to common paths (e.g., configuration files, environment files) — to identify potential security exposures. Results are stored internally and may be used to improve our products and services. No exploitation of any discovered issues occurs. You consent to this additional scanning by submitting your domain.
5. User Responsibilities
You agree to use the Service only for lawful purposes. You must not use the Service to scan websites you do not own or do not have explicit authorisation to test. You are solely responsible for ensuring your website complies with all applicable laws and regulations.
5.1 Data and Privacy
Your use of the Service involves the processing of personal data as described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
6. Paid Plans — Delivery and Refund Policy
6.1 Digital Delivery. Paid compliance reports and plan deliverables are provided digitally. Delivery is confirmed when the report or access credentials are made available to you.
6.2 Individual Plan and Company Plan — Refund Eligibility. A refund will be issued, less a 10% administration fee, provided that: (a) you request the refund within 7 days of the date we receive your payment; AND (b) you have not yet run any compliance report under the relevant plan. Once a report has been generated, the plan is considered used and no refund will be issued. To request a refund, contact legal@sitetals.com with your order reference.
6.3 Agency Plan — Monthly Billing. Agency Plans billed on a monthly cycle are non-refundable. No refund is available for the current or any past billing period.
6.4 Agency Plan — Annual Billing. Agency Plans billed annually may receive a partial refund for unused complete months remaining in the annual subscription period. Unused months are calculated from the next anniversary of your plan start date following the refund request date — the current partial month is not refundable. A 10% administration fee plus any applicable bank transfer fees will be deducted from the refund. To request a refund, contact legal@sitetals.com with your order reference and plan start date. Refunds are processed within 14 business days.
6.5 Technical Failures. If a technical error on our side prevents delivery of a report you paid for, we will re-deliver the report or issue a full refund at your option. Contact legal@sitetals.com within 30 days of the failed delivery.
6.6 Business customers — exclusion of statutory withdrawal right. Our services are for businesses and professionals acting in the course of their professional activity. Orders are concluded at a distance, electronically, on our website. On that basis, no statutory right of withdrawal and no statutory cooling-off period applies to your order.
6.7 EU consumer rights safety net. Should a court of competent jurisdiction determine that you qualify as a consumer under applicable EU law, nothing in these Terms affects the mandatory statutory consumer protection rights to which you may be entitled.
6.8 Taxes and VAT. All prices displayed on the Service are exclusive of any applicable taxes. QUIKFORGE LIMITED is incorporated in Hong Kong and is not registered for VAT in the European Union. For business customers in the European Union, VAT may be due under the reverse charge mechanism pursuant to the applicable EU VAT Directive; invoices will indicate that the reverse charge applies where appropriate. If Goods and Services Tax (GST) or any other tax applies to your purchase under the law of your country, this will be indicated at checkout and on your invoice. You are responsible for correctly accounting for and remitting any taxes due on your purchase. Further details are set out on your invoice.
6.9 Cancellation window. The cancellation option described below is granted by Sitetals as a matter of contract: it is binding on us and applies to every order, regardless of your country of establishment.
6.9.1 Your cancellation window. You have 7 days from receipt of your payment to cancel your order and obtain a refund, provided no report has been generated under your access key. To cancel, inform us by a written statement (e.g. an email to legal@sitetals.com) quoting your invoice number. To meet the deadline, it is sufficient that you send your request before the period expires. If you cancel in time and no report has been generated, we will refund the payments received from you, less the 10% administration fee on the order price set out in §6.2, without undue delay and using the same means of payment you used.
6.9.2 Generating a report ends the window. Generating a report under your access key is performance of the service you ordered: the report is yours to keep and cannot be given back. Generating any report under your access key immediately and permanently ends the cancellation window for that order, whether or not the 7 days have elapsed. So that the position is clear before anything is generated, we ask you to acknowledge this at two points: (a) at checkout, you acknowledge that your order carries a 7-day cancellation window, and that generating your report during that window ends it and means no refund is possible; and (b) at report generation, before your first report is generated, you confirm that you request immediate generation now and thereby end the remaining window for this order. Until you generate your first report, the window in §6.9.1 stays fully available, and you may simply wait rather than generate. Once a report has been generated following your acknowledgement, the no-refund rule in §6.2 applies and no refund is available.
6.9.3 After the window. After the 7-day period your order is final and no further cancellations are permitted.
7. Intellectual Property
All content, design, and methodology on Sitetals.com is the property of Sitetals and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
8. Limitation of Liability
To the maximum extent permitted by law, Sitetals.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any compliance actions taken based on our reports. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Availability
We strive to maintain continuous availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, technical issues, or events beyond our control may result in temporary unavailability.
10. Modifications
We reserve the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised terms.
11. Governing Law and Jurisdiction
These Terms of Use are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles. Any dispute, controversy, or claim arising from or in connection with these Terms of Use shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
For disputes arising from contracts with consumers habitually resident in the European Union, the mandatory consumer protection provisions of the applicable EU member state law shall apply in addition to Hong Kong law, as required by the Rome I Regulation (EC/593/2008). EU consumers may also bring proceedings in the courts of their country of residence.
12. Alternative Dispute Resolution
This Service is directed exclusively at businesses and professionals. The EU Alternative Dispute Resolution framework (Directive 2013/11/EU, as amended by Directive 2025/2647) does not apply to purely business-to-business disputes.
We are not obligated to participate in alternative dispute resolution (ADR) proceedings and have not voluntarily submitted to any ADR body. Should a court of competent jurisdiction determine that you qualify as a consumer, you may contact an ADR body recognised by the competent authority in your Member State. A current list of recognised ADR entities in EU Member States is available on the European Commission website at consumer-redress.ec.europa.eu/dispute-resolution-bodies.
Our contact email for dispute resolution enquiries is legal@sitetals.com.
13. Contact
For questions about these Terms of Use, please contact us at legal@sitetals.com.
14. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable in whole or in part, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the economic intent of the original provision.
15. Entire Agreement
These Terms of Use constitute the entire agreement between you and Sitetals with respect to their subject matter and supersede all prior agreements, understandings, or representations. Our Privacy Policy is a unilateral notice describing how we process personal data and does not form part of these Terms.
16. Assignment
Sitetals may assign or transfer its rights and obligations under these Terms of Use in whole or in part to an affiliate or to a third party in the context of a corporate transaction, without your prior consent. You may not assign or transfer your rights or obligations under these Terms of Use without our prior written consent.
17. Waiver
Failure by Sitetals to enforce any provision of these Terms of Use shall not constitute a waiver of the right to enforce that provision at a later time.
18. Governing Language
These Terms of Use are provided in English only. English is the governing language for all purposes.
